A marital settlement agreement is really the agreement that the two parties that have been married will sign in order to resolve their case. The marital settlement agreement is going to have included in it any division of assets, any divisions of debts, any divisions with regards to anything related to the children. It may include a parenting plan that will detail all; the time sharing for the children that will detail out how decisions or what kinds of decisions will be made for the children, whether the parties will need any additional things inside of their marital settlement agreement really goes into the specifics of their marriage.
Some parties will have issues that deal with taxes before and/or after the marriage. The issues of child support, alimony, all of the things that will need to be resolved in order to resolve the case are typically included in a marital settlement agreement.
You can have these done as a whole to resolve the entire case or they can be done partially if there are issues that both parties can agree on even if they can’t agree on the entire case you can do a partial settlement agreement or partial marital settlement agreement that will detail out those issues that you are in agreement to and that way when you go to court whether for a hearing or for a trial you’re limiting the issues that you’re handling because you’re only limited to the things that you don’t agree on.
So instead of having to prepare for all of the issues that are involved in a divorce you’ll only have to prepare for the limited issues that the parties have not yet agreed to.See all videos
